This Privacy Policy describes how Clive Coffee ("we," "us," or "our") collects, uses, and shares personal information when you visit, shop on, or otherwise interact with clivecoffee.com (the "Site"), or sign up for our SMS or email marketing programs.

Personal Information We Collect

Device Information. When you visit the Site, we automatically collect information about your device and browser, IP address, time zone, and cookies installed on your device. We also collect information about the pages or products you view, what site or search term referred you here, and how you interact with the Site. We call this "Device Information," collected via:

  • Log files — track actions on the Site and record IP address, browser type, internet service provider, referring/exit pages, and date/time stamps.
  • Web beacons, tags, and pixels — record how you browse the Site.

Order Information. When you make or attempt to make a purchase, we collect your name, email address, billing and shipping address, payment information (including credit card numbers, PayPal, and/or Affirm account details), and phone number.

Marketing Information. If you opt in to SMS or email marketing, we collect your phone number and/or email address, along with your consent status and preferences.

Together, Device Information, Order Information, and Marketing Information are referred to as "Personal Information."

How We Use Your Personal Information

We use Order Information to fulfill orders (processing payment, arranging shipping, providing invoices/confirmations), and to:

  • Communicate with you about your order or account;
  • Screen orders for potential risk or fraud; and
  • Send you marketing communications, where you've opted in.

We use Device Information to help screen for risk and fraud, and to improve and optimize the Site — for example, by analyzing browsing behavior and evaluating our marketing campaigns.

We use Marketing Information to send you promotional emails and text messages you've signed up to receive.

We occasionally share Device Information with Google and Facebook for retargeting advertising purposes. We do not pass Personal Information to these platforms — only anonymized data used to show you relevant ads based on your browsing.

SMS Marketing

If you opt in to receive SMS/text messages from us, you consent to receive recurring automated marketing messages at the phone number provided. Consent is not a condition of any purchase. Message and data rates may apply, and message frequency varies. Reply STOP to unsubscribe at any time, or HELP for assistance. We do not sell or share your phone number with third parties for their own marketing purposes. Our SMS program is operated in accordance with the Telephone Consumer Protection Act (TCPA) and applicable carrier guidelines.

Sharing Your Personal Information

We share Personal Information with service providers who help us operate the Site and fulfill orders:

We do not sell your Personal Information to third parties, and we do not consider our advertising/analytics arrangements a "sale" or "share" of Personal Information as those terms are typically defined under U.S. state privacy law, because we do not exchange your Personal Information for money and use it solely for retargeting/analytics on our behalf. [Note: confirm this characterization with counsel — under the CPRA, sharing data with ad platforms like Google/Facebook pixels for cross-context behavioral advertising is often treated as a "share" even without payment, which would require honoring opt-out requests below regardless of how you characterize it internally.]

We may also disclose Personal Information to comply with applicable laws, respond to a subpoena, search warrant, or other lawful government request, or to protect our rights, property, or safety, or that of our customers.

Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect your Personal Information from unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Data Retention

When you place an order, we retain your Order Information for our records to comply with legal, tax, and accounting requirements, unless and until you ask us to delete it (subject to those legal obligations). Marketing Information is retained until you opt out or ask us to delete it.

Children's Privacy

The Site is not directed to children under 16, and we do not knowingly collect Personal Information from children under 16. If we learn we have collected such information, we will take steps to delete it.

Behavioral Advertising

  • Access the specific pieces of Personal Information we hold about you;

We do not sell Personal Information for money. To the extent our use of advertising cookies/pixels is considered "sharing" for cross-context behavioral advertising under the CPRA, you can opt out using the links in the Behavioral Advertising section above, or by contacting us using the information below.

If you are located in the European Economic Area or UK, you have the right to:

  • Access the Personal Information we hold about you;
  • Correct or update inaccurate information;
  • Request deletion of your information;
  • Restrict or object to our processing of your information;

  • Lodge a complaint with your local data protection supervisory authority.

We process your information to fulfill contracts with you (e.g., orders placed through the Site) or to pursue our legitimate business interests described above. Your information may be transferred outside Europe, including to Canada and the United States, using appropriate safeguards such as Standard Contractual Clauses where required.
